Welcome to Gallerai (“Gallerai”, “we”, “us”, “our”). By accessing or using our website, web applications, content, or subscription services (collectively, the “Service”), you agree to be bound by these Terms of Service (“Terms”).

If you do not agree to these Terms, you must not use Gallerai.

Important: These Terms include limitations of liability, disclaimers of warranties, and provisions that allocate risk to you. Please read them carefully.

1. About Gallerai

Gallerai is a pre-generation platform for AI creators. Our Service currently includes:

• Gallery – a curated library of AI-generated images, visual assets, and associated prompts for educational, creative, and inspirational purposes.

• Recreator – an image-to-prompt tool that allows users to upload images and receive reverse-engineered prompts and descriptive breakdowns.

• Refiner – a text-based tool that helps users transform rough or unstructured prompt ideas into clearer, more structured prompts.

  Collectively, these and any future tools, features, and content form the Gallerai Service.

We provide access to, among other things:

• AI-generated images and visual assets

• Associated prompts and prompt data

• Downloadable content (including PDFs)

• Web-based tools that generate or refine prompts based on your input

• Subscription-based access features (“Access Pass” or similar)

Unless stated otherwise, all content and tools are provided for educational, creative, and inspirational purposes only.

2. Eligibility

You must be at least 18 years old to use Gallerai. By using the Service, you confirm that:

• You are at least 18, and

• You have the legal capacity to enter into a binding agreement.

3. Accounts & Subscriptions

Some features of Gallerai require creating an account and/or purchasing a subscription.

• Access Pass / Paid Plans
  Certain features (including full access to the Gallery, Recreator, Refiner, and future tools) are available only with a paid subscription.

• Billing Periods
  Subscriptions may be billed monthly, yearly, or as otherwise stated at checkout.

• Account Security
  You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account.

• Suspension / Termination
  We may suspend or terminate your account and/or access to the Service if we reasonably believe you have violated these Terms, abused the Service, or engaged in unlawful or harmful behaviour.

4. Payments & Billing

• Payments are processed via third-party payment providers (e.g. Stripe).

• Subscription fees are non-refundable, except where required by applicable law.

• You may cancel your subscription at any time; your access will continue until the end of the current billing period.

• We may change pricing in the future; if we do, we will notify existing subscribers in advance in a reasonable manner.

All prices and billing terms are as displayed at the point of purchase.

5. Acceptable Use

You agree that you will not:

1. Resell, redistribute, or sublicense Gallerai content (including prompts, images, or tool outputs), except as expressly permitted by our Licensing Policy or a separate written agreement.

   
   

2. Scrape, download in bulk, or harvest content, including by using bots, crawlers, or automated scripts, except as explicitly allowed by us.

   
   

3. Use the Gallery, Recreator, or Refiner to create, assist, or distribute content that is:

   • Illegal or infringing

   • Harassing, hateful, or abusive

   • Deceptive, fraudulent, or misleading

   • In violation of any third-party platform’s terms

   
   

4. Attempt to circumvent access controls, paywalls, or usage limits.

   
   

5. Interfere with or disrupt the Service, including by introducing malware or attempting to gain unauthorised access.

We reserve the right to monitor use of the Service to enforce these Terms.

6. Intellectual Property

Unless otherwise stated:

• All content on Gallerai — including images, prompts, text, logos, branding, design, and underlying software — is owned by or licensed to Gallerai.

• You are granted a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your own personal or internal business purposes, subject to these Terms and our Licensing Policy.

• Access to content does not transfer ownership of any intellectual property.

Your use of images, prompts, and other content is additionally governed by our Image & Prompt Licensing Policy, which forms part of these Terms by reference.

7. User Submissions & Inputs

You may submit or upload content to the Service — including, but not limited to:

• Images you upload into Recreator

• Text, ideas, or partial prompts you enter into Refiner

• Any other materials or data you provide to us (collectively, “User Input”)

By providing User Input, you agree that:

1. You have all necessary rights to provide the User Input, and your submission does not infringe any third-party rights (including copyright, trademark, privacy, or publicity).

2. You remain responsible for User Input, including its legality and appropriateness.

3. You grant Gallerai a non-exclusive, worldwide, royalty-free license to host, process, and use your User Input solely for:

   • Operating and improving the Gallerai Service

   • Generating outputs (including prompts and breakdowns) for you

   • Maintaining security and integrity of the Service

   
   

   We may remove or restrict access to User Input at our discretion if we reasonably believe it violates these Terms or applicable law.

8. Recreator & Refiner Outputs

When you use Recreator or Refiner, the Service may generate text outputs such as:

• Prompt breakdowns

• Reverse-engineered prompts

• Refined or reformatted prompts

• Descriptions, labels, or structural suggestions

(collectively, “Output”).

You understand and agree that:

1. Outputs are automatically generated based on your User Input and/or internal models; they are not guaranteed to be accurate, unique, or free from error.

2. Other users may receive similar or identical Output, especially for common concepts or references. We do not guarantee exclusivity or originality.

3. Gallerai does not and cannot guarantee that any Output:

   • Will be free of third-party rights issues

   • Will comply with any platform’s terms of service

   • Is suitable for commercial or production use without further review, editing, or legal clearance

   
   

4. You are solely responsible for:

   • Reviewing Output before use

   • Ensuring that your use of Output complies with applicable laws, regulations, and third-party agreements

   • Any content you generate using Output in any third-party tool or model

   
   

9. No Liability for Inputs or Outputs

To the fullest extent permitted by law:

• Gallerai shall not be liable for any claims, losses, or damages arising from or relating to:

  • The User Input you provide into Recreator, Refiner, or any other part of the Service

  • Any Output generated by the Service

  • Any content you create, publish, or distribute using such Output in third-party tools or platforms

You use User Input and Output entirely at your own risk.

You understand that using Recreator to analyse or emulate an existing image (including third-party photos, artworks, or designs) does not grant you any rights to that original work, and you are responsible for ensuring your use is lawful and compliant.

10. Disclaimer of Warranties

The Gallerai Service (including Gallery, Recreator, Refiner, and all content and tools) is provided “as is” and “as available” without warranties of any kind, whether express or implied.

We specifically do not warrant that:

• The Service will be uninterrupted, error-free, or secure

• Outputs will be accurate, reliable, unique, or commercially suitable

• Prompts or images will meet your expectations or specific requirements

• The Service is free from viruses or other harmful components

Your use of the Service is at your own risk.

11. Limitation of Liability

To the fullest extent permitted by law:

• Gallerai, its founders, employees, contractors, and affiliates shall not be liable for any indirect, incidental, consequential, special, or punitive damages arising out of or related to your use of (or inability to use) the Service.

• Our total aggregate liability to you for any claims arising out of or related to the Service shall be limited to the amount you paid to Gallerai in the 3 months immediately preceding the event giving rise to the claim, or £50, whichever is greater.

Some jurisdictions do not allow certain exclusions or limitations of liability, so some of the above may not apply to you. In such cases, our liability will be limited to the maximum extent permitted by law.

12. Indemnity

You agree to indemnify, defend, and hold harmless Gallerai and its founders, employees, contractors, and affiliates from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to:

• Your use of the Service (including Gallery, Recreator, or Refiner)

• Your User Input or any content you upload or submit

• Your use of Output in any context

• Your violation of these Terms or any applicable law

• Your infringement or alleged infringement of any third-party rights

This clause is meant to make clear: if you misuse the tools, upload something you shouldn’t, or use Output in a way that causes legal trouble, that risk is on you, not us.

13. Termination

We may suspend or terminate your access to the Service at any time, with or without notice, if we reasonably believe that:

• You have violated these Terms

• Your behaviour exposes us or other users to risk or liability

• We are required to do so by law or a competent authority

Upon termination:

• Your right to use the Service will immediately cease

• We may, but are not obliged to, retain User Input and account data as permitted by our Privacy Policy and applicable law

You may also stop using the Service at any time and/or cancel your subscription via your account or billing provider.

14. Changes to the Service & Terms

We may update or change:

• The Service (including adding, modifying, or removing features or tools such as Gallery, Recreator, and Refiner)

• These Terms

When we make material changes, we will notify you by updating the “Last updated” date and, where reasonable, via email or in-product notice. Continued use of the Service after changes take effect constitutes your acceptance of the updated Terms.

15. Governing Law

These Terms, and any dispute arising out of or related to them, are governed by the laws of England and Wales, without regard to conflict of law principles.

You agree that the courts of England and Wales shall have exclusive jurisdiction, except where applicable law provides otherwise.
